NOTE: Fees depends on many factors including the area of technology, the number of component parts, the number of steps, the closeness of prior/related art, the nature of the drawings, the quality of the materials provided by the inventor and the number of revisions requested by the client.
Prosecution / Processing of Application - from $3,000 to $10,000 assuming no appeals or continuation applications are filed. The cost varies greatly from case to case depending on where the patent application was filed (Canada, the USA, Europe, etc) and the number and nature of office actions. We cannot provide a precise estimate of the costs of patent prosecution, and can only provide a range.
Government Fees - In addition to the above referenced fees, there will be several government fees due on the filing of the application and during the course of prosecution. These fees include the filing, examination, maintenance, and issue/publication fees. In addition, there may be completion fees, extension fees and reinstatement fees, depending on how the application is prosecuted. The following is a sampling of these fees for Canada and the USA. Please refer to the USPTO and CIPO web sites for an up to date list of fees.
For Canada - Filing fee $200, examination fee $400, issue fee $200 and annual maintenance fees $50 (for small entity).
For USA - Filing fees $400 to $800, issue/publication fee about $400 (for small entity).
